Puppy Sales Contract
The Breeder agrees to sell this purebred Border Collie puppy for the price of $_______. This amount to be paid in full before Buyer takes possession. All costs related to shipping such as airline approved crate, health certificate, etc., to be paid in advance. You must put down a $100.00 non-refundable deposit to hold a puppy from this litter.
The kennel name “Ignited” must be used as the first word of the registered name in any and all registries.
To the best of Breeder’s knowledge, this puppy is free of disease and defects at the time of sale. The pup was examined by our vet just prior to leaving for his/her new home and if there were any concerns they have been disclosed to you. Except for emergencies, it would be best to keep the pup away from the vet’s office until they have settled into their new home and are no longer stressed. We’ve heard too many horror stories of new pups going for a well puppy checkup and getting sick from something they picked up there. There is no warranty against accidents or sickness not contracted on the Breeder’s premises.
The Breeder warranties this puppy as follows: to be free from hereditary hip dysplasia and genetic eye defects for a period of 26 months. The Buyer agrees to have this dog’s hips OFA certified or Penn-Hip rated at 24 months and a copy of the official certificate sent to the Breeder. If the x-rays show the dog has hip dysplasia not caused by accident or the actions or neglect of the Buyer, the following mutually exclusive remedies are available: 1. Spay or neuter the dog and furnish it with a loving home for the remainder of its life and the Breeder will refund half the purchase price upon proof of spaying or neutering on the letterhead of the performing veterinarian. 2. Keep the dog, and on proof of neutering, a comparable puppy from the next available litter will be given at half purchase price. In the event that a claim is made of genetic/inherited health problems, the Buyer is required to send all veterinary records and x-rays to Breeder for a second opinion before any compensation is made. A copy of hip and eye clearances and all other health screenings to be sent to the Breeder within 30 days of receipt for our records.
Purchaser agrees to exercise normal care in maintaining this puppy’s health. Stressing a pup’s bones and joints by excessive exercise, jumping over elbow height or weaving before the growth plates are closed will null and void the hip warranty. Pup will be given minimal vaccinations, one Parvo shot at 12 weeks, followed by one distemper at 16 weeks and no more during it’s lifetime. All vaccines given must be killed when available and preservative free. Rabies as required by law, but not before 8 months of age, preferably after all teething is done. We would prefer that no vaccines or chemicals of any kind be given, but know that most people will not be comfortable with that idea. Under no circumstances is the pup to receive any heartworm preventative that contains Ivermectin. Many dogs of herding breeds have had bad reactions to it. HeartGuard contains Ivermectin, Interceptor doesn’t. Again, we would prefer no chemicals be given since a healthy dog fed a species appropriate diet will be able to fend off parasites on their own. Good quality food to be fed. For optimum health, Breeder recommends that this puppy be fed a raw food diet, (this is the species appropriate diet) which is what it will be weaned onto. If the dog is to be neutered or spayed, it must be done after the growth plates are closed and the pup is sexually mature. All costs of spay/neuter to be borne by Buyer. If Buyer has an interest in naturally rearing their pup for optimum health, we would be thrilled to give all help and information we possibly can.
If it is confirmed that this dog is being abused or neglected, rights and ownership of the dog will automatically terminate and revert back to the Breeder who may immediately assume possession of the dog. This includes that the pup/dog will be a house pet, not live in a kennel or constantly crated. The Buyer will immediately notify the Breeder if at any time the puppy/dog, for any reason, at any age, cannot be kept or is no longer wanted. AKC and ABCA registration papers, with a signed transfer, must be returned with the pup if it is returned for any reason. Buyer agrees to return puppy/dog to Breeder at Buyer's expense and foregoe all rights to said dog with no refund of purchase price. It is agreed that at no time will the Buyer sell or give this puppy away to any person or institution, including but not limited to, animal shelters, rescue organizations, pet stores, puppy mills or any similar operations, or have euthanized without written permission from Breeder. The exception to euthanasia would be in the case of severe injury or suffering on the part of the dog.
This puppy is being sold as a performance prospect and must be titled in some venue. Notification of all titles earned to be sent to Breeder within 30 days of receipt for our records.
The Buyer understands that the pup will be registered under AKC and ABCA Limited Registration. This means that any pups produced from this dog cannot be registered. Limited registration may be lifted if all health tests are passed and pup is deemed to be worthy of breeding. Health tests include but are not limited to, OFA/PENNHIP, BAER, CERF and CEA DNA if not clear by parentage. Buyer shall pay all costs of health testing. Any dogs being bred to must also have all health clearances done. If a bitch, she will not be bred on consecutive heats without the permission of the breeder. The Breeder does not guarantee the pup to be breeding quality. This dog will not be used to produce mixed breed dogs for any purpose.
The Buyer agrees to make any claims arising out of the foregoing warranties no later than the day the dog turns 26 months old. After that date the Breeder will no longer be responsible to the Buyer in these matters. However it is understood by the Buyer that the dog will come back to Breeder as per above for the lifetime of the dog.
No other warranties or guarantees, expressed or implied, are made under this contract except as stated herein.
PURCHASING A PUPPY IS A LIFETIME COMMITMENT. IGNITED BORDER COLLIES ARE ONLY PLACED IN LOVING HOMES THAT AGREE TO THE ABOVE TERMS. THE BREEDER’S INTEREST IN THE PUPPY DOES NOT STOP WHEN IT LEAVES US. WE EXPECT REGULAR UPDATES ON THE PUP’S HEALTH, WELL-BEING AND ACTIVITIES.
This written agreement is a binding contract entered into in the State of Illinois, County of Will.
Having read the above terms and conditions, and fully understanding the contents herein, I/we enter into this agreement.
